1. Agreement to Terms

By accessing or using the LUNA – AI Art Generator application (“App”) and the website at lunaaiapp.com (“Website”), operated by Rocket Digital Limited (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our services.

2. Description of Service

LUNA is an AI art generator application that allows users to create images from text prompts using artificial intelligence models. The App is available on iOS and Android platforms and provides various AI-powered image generation features including text-to-image creation, portrait generation, and style transfer.

3. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use LUNA. By using the App, you represent and warrant that you meet the minimum age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must provide accurate and complete information when creating an account.
• You must notify us immediately of any unauthorized use of your account.

5. Subscriptions and Payments

5.1 Free and Premium Tiers

LUNA offers both free and premium subscription tiers. The free tier includes advertisements served by Google AdMob and limited generation credits. Premium subscriptions provide additional features and remove advertisements.

5.2 Payment Processing

Subscriptions are processed through the Apple App Store or Google Play Store, and managed by RevenueCat. All payments are subject to the terms and conditions of the respective app store.

5.3 Cancellation and Refunds

You may cancel your subscription at any time through your app store account settings. Refunds are handled according to the policies of Apple App Store or Google Play Store.

6. Acceptable Use

You agree not to use LUNA to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create content that infringes on any third party's intellectual property rights
• Generate deepfakes or non-consensual imagery of real people
• Produce content depicting minors in inappropriate situations
• Create content that promotes violence, hatred, or discrimination
• Circumvent any content moderation or safety measures
• Use automated tools to access the service in a manner not authorized by us
• Reverse engineer, decompile, or disassemble any part of the service
• Resell or redistribute the service without authorization

7. Intellectual Property

7.1 Generated Content

Subject to your compliance with these Terms and applicable subscription terms, you retain rights to the images you generate using LUNA. However, we make no guarantees regarding the uniqueness of generated content, and similar prompts may produce similar results for different users.

7.2 LUNA Intellectual Property

The LUNA app, website, branding, and all associated intellectual property remain the exclusive property of Rocket Digital Limited. You may not copy, modify, or distribute any part of our service without prior written consent.

7.3 AI Model Providers

LUNA utilizes AI models from third-party providers including OpenAI, Microsoft Azure, Replicate, and Fal.ai. Your use of generated content may also be subject to the terms of these providers.

8. Content Moderation

We employ automated and manual content moderation to enforce our acceptable use policy. We reserve the right to refuse generation requests, remove content, or suspend accounts that violate these Terms without prior notice.

9. Disclaimers

• LUNA is provided “as is” and “as available” without warranties of any kind.
• We do not guarantee that the service will be uninterrupted, secure, or error-free.
• AI-generated images may not always accurately reflect your prompts.
• We are not responsible for the accuracy, quality, or appropriateness of generated content.
• We do not guarantee that generated images are free from intellectual property claims.

10. Limitation of Liability

To the maximum extent permitted by law, Rocket Digital Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from or related to your use of LUNA, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Rocket Digital Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of LUNA or violation of these Terms.

12. Termination

We may terminate or suspend your access to LUNA at any time, with or without cause, and with or without notice. Upon termination, your right to use the service ceases immediately. Provisions of these Terms that by their nature should survive termination shall continue in effect.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date and, where appropriate, providing additional notice within the App. Your continued use of LUNA after changes constitutes acceptance of the updated Terms.
